Former fugitive gets bail on murder charge

A judge on Wednesday approved bail for a former murder case fugitive after ruling the evidence against him was weak.
Jason Reuben Marshall, 32, allegedly fled The Bahamas following the January 25, 2005 shooting death of Fabian Joffer at West Dennis Court in Yellow Elder Gardens.
He was deported from Philadelphia, Pennsylvania in February 2011. Marshall was arrested in Philadelphia for assault after he got into a confrontation with another man on October 2, 2010.
At the time, the police said they put in a request to see if there were any warrants against Marshall.
It was later discovered that he was also wanted in The Bahamas in connection with a homicide in 2005.
Marshall's lawyer, Ian Cargill, grounded his bail application on the tenuous evidence against him. Witnesses' statements revealed that there were three persons called Jason at the scene, including the defendant. One of those men also shared the same surname as the defendant.
Police did not hold an identification parade to determine which Jason was allegedly responsible for Joffer's death.
Justice Vera Watkins set bail at $9,500. Marshall's sureties have not been approved yet so he was returned to Her Majesty's Prisons.
