Court of Appeal denies bail of man accused of conspiracy to commit murder

The Court of Appeal has denied bail for a man charged with conspiracy to commit murder earlier this year.

As a result of the decision, 27-year-old Stephon Davis will remain in custody until his trial.

Davis was on bail for two murders when he and Corporal Darren Davis were accused of conspiring to kill Jayson Whitfield, a senior clerk at the Passport Office, last December.

On February 10, Justice Renae McKay refused his bail application, saying that he was a threat to public safety.

The 43-year-old was found shot dead on December 3, 2022 inside his government-assigned car in Garden Hills.

Prosecutors allege that the pair planned Whitfield's murder.

It is alleged that the officer and the deceased were seeing the same woman and he had threatened to kill Whitfield. The Davises allegedly exchanged phone calls and WhatsApp messages before and after the murder.

In a cautioned statement, Davis allegedly said the officer had asked him to provide him with a gun.

The Court of Appeal said, "The applicant is currently under bail in two separate cases for similar offenses. There is some evidence connecting the applicant to the murder of the deceased. In these circumstances, the judge concluded the applicant was a danger to public safety and order under the Bail Act. Considering the evidence presented, albeit circumstantial, it was not unreasonable for the judge to form this conclusion."
