A Supreme Court judge has denied bail to the wife of the late Phillip Vasyli, who was found dead at his home in the exclusive Old Fort Bay community on March 24.

Donna Vasyli, 54, was charged with his murder on March 30 and remanded to the Bahamas Department of Corrections, formerly known as Her Majesty's Prisons.

At her arraignment, Vasyli told supporters, "I'll be out of here in no time." She applied for bail before Senior Justice Stephen Isaacs on April 2, just three days after her initial court appearance.

Her attorney Murrio Ducille said that the prosecution's case against Vasyli is weak. He pointed to the case of Cuban-Americans Daniel Ayo and Luis Mendez, who were released on $50,000 bail for the 2010 murder of Jamaican Clive Tomlinson at Bimini.

The Court of Appeal approved the decision to grant bail for Ayo and Mendez after a challenge by the prosecution.The Crown eventually discontinued the case against them. Assistant Director of Public Prosecutions Neil Brathwaite argued that Vasyli is not a Bahamian citizen and has homes in other countries.

Isaacs denied the application, saying that there had been no unreasonable delay in the case. He said a bail hearing was not the forum to test the strength of the prosecution's case.Isaacs said Vasyli's matter was distinguishable from the Ayo and Mendez case as they were clearly in the pursuit of a felon.

Isaacs said there is also a concern that Vasyli would not return to court for her trial. Ducille intends to appeal the decision.

In addition to establishing several podiatry clinics in Australia, Phillip Vasyli founded an orthotic footwear company that sells products around the world.

Vasyli and his family also established the Vasyli Foundation, which supports a number of charities internationally which strive to improve health outcomes in poor and underprivileged communities The foundation has provided financial support to several organizations in The Bahamas.
