Court denies bail after man 'lied' in affidavit

A court yesterday refused to give bail to a man who "lied" about his criminal history in an affidavit.
Kenyon Ferguson was seeking bail pending appeal of his conviction for a drug possession offense.
In the affidavit prepared by his lawyer, Geoffrey Farquharson, Ferguson claimed that he had no previous convictions.
However, prosecutor Aaron Johnson debunked this assertion by presenting Ferguson's criminal record that showed four convictions for guns and drugs, the most recent of which occurred in January 2012.
Court President Anita Allen said, "An affidavit is a serious thing. You swear the contents of an affidavit. If you have lied in an affidavit, it is a criminal offense. That is perjury."
Farquharson said that the affidavit was "inaccurate" because his client may have misunderstood the questions he asked him.
Allen told the court that his explanation was unacceptable. She said he was acting as though the appellate judges were new to the bench. She said, "We've heard it all."
Allen said that the exposure of the untruth cast the bail application in a different light.
The court refused the bail application and promised to list the appeal for July.
