A judge yesterday ordered a retrial after a jury was unable to decide whether Benson Ismy was guilty of murder.
Prosecutors alleged that Ismy shot Jerome Davis in the head at the Magic City parking lot on July 7, 2012.
According to the Crown, the shooting was the result of a fight that began inside the club.
But jurors were unable to reach a unanimous verdict on his guilt, standing divided 10-2.
The jury convicted Ismy of possession of a .357 revolver and two bullets for the weapon on July 8 by the same count.
Justice Roy Jones will sentence Ismy on the firearm and ammunition charges in January.
He returns to court on Friday for a new trial date on the murder charge.
Abigail Farrington prosecuted. Tamara Taylor appeared for Ismy.
