Man lodges appeal against court order to take paternity test
A man who has denied fathering a baby has lodged an appeal against a magistrates' order to take a paternity test.
The putative father of the 19-month-old appeared before Chief Justice Sir Michael Barnett on Thursday to challenge the order of Family Court Magistrate Ellen Serville.
The man's lawyer, Raphael Moxey, argued that the magistrate should not have made the order until she had heard all of the facts of the case.
Romona Farquharson-Seymour, who appeared for the mother, countered that the appeal should fail because Moxey acknowledged that the magistrate had the power to make the order.
Farquharson-Seymour submitted that the court was able to exercise its discretion at any stage of the proceedings.
The court reserved its decision on the issue.
In another appeal emanating from the Family Court, a man has challenged a magistrate's order that he pay private school fees for his daughter who was born out of wedlock.
Farquharson-Seymour represented the man, whose daughter was attending Jordan Prince Williams when her mother moved her to Temple Fellowship School without consulting him. The court heard that the mother moved the child, although her father had already paid her tuition a year in advance.
Farquharson-Seymour said that although there is a commonly held view that private schools are superior to public ones, there is nothing to show that the child's welfare would be threatened by attending a public school.
The mother's lawyer, Clarita Lockhart, asked the chief justice to alter the January 2011 order of Magistrate Carolyn Vogt-Evans so that the fees would be paid at the original school.
However, Farquharson-Seymour said the man was no longer in a position to pay tuition at any school because of a change in his circumstances.
Chief Justice Sir Michael Barnett has also reserved his ruling in that case.

OBB inks accord with condo owners
After several months of deliberations, Old Bahama Bay Resort & Marina (OBB) has finally come to an agreement with 73 condominium owners to sever ties.
The result is a new company called Island Ventures Resort & Club Ltd. (IVRC), which will take up responsibilities for the hotel and marina at the property. OBB is now in a state of downsizing and consolidation, reducing the size of its operations so it can focus on development on its north shore.
Crave Real Estate, a Canadian-based advisory, has continued to court foreign investment to the prime piece of land on Grand Bahama.
The new company appointed to run the hotel is led by James Culmer of West End, who will serve as general manager, and Jackie Carroll, coming on as resort manager. According to a statement, advisory services will be taken up by Management Services LLC, a Florida-based hospitality consulting company.
"This new arrangement brings together the major stakeholders at Old Bahama Bay to share in the benefits and obligations of property operations. LRA (the parent company of OBB) will continue to maintain a small team of Bahamian employees and consultants to manage other facets of the Old Bahama Bay project."
Last year, CEO and President of the Crave Group Lorne Bassell announced that OBB was targeting up to 30 homes on the western tip of Grand Bahama, more specifically Freeport Harbour, and slowly expand outwards. He officially announced the partnership with West End Resort Ltd., a key landowner in the area.
With the issue of the condominium owners now resolved, developers at OBB could be in a better position to move forward on this planned development.
"This is an exciting new opportunity for the management and staff at Old Bahama Bay," said Culmer, the new general manager. "We look forward to implementing new marketing programs for the resort and providing high quality, friendly service to our owners and guests."
Back in May, OBB laid off 29 workers in an effort to further consolidate operations. Security guards, accountants, maintenance employees and food and beverage workers all received pink slips in the process. A number of these layoffs, in fact, were linked to the severing of ties with condo owners.
OBB supplied management and maintenance services to these property owners for years, but given the current economic times, it was simply no longer feasible.
