Lawyer bids to appeal private school order

A lawyer for an unmarried man ordered to pay private school fees for a child born out of wedlock is trying to convince the Court of Appeal to hear the matter.
Romona Farquharson was unsuccessful in her first attempt to convince the chief justice to overturn the order of Magistrate Carolyn Vogt-Evans in respect of Henry Thurston.
Farquharson won't be able to argue the appeal unless she satisfies the court that the matter is of general public importance.
Farquharson said, "This is now a secondary appeal against a magistrate's finding. Ordinarily the matter would stop there, unless you can convince the court that it's a point of general public importance.
"I think that it is. The issue is does the magistrate have the jurisdiction to order an unwed father to pay fees at a private institution without his consent?"
According to Farquharson, the point has never been raised before. She said she intended to argue whether private schools are better than public ones and whether a private school education was a necessity or a luxury.
Farquharson filed her skeleton arguments yesterday and will argue the issue on March 14.
