Notice

To: The Defendant

Pursuant to an Order of the Supreme Court in this matter dated the 24th day of June A.D., 2011.

Take Notice that:

1. This action has been commenced in the Supreme Court against you by way of the Originating Summons filed on the 21st day of April A.D., 2010 and claiming the following relief.

            a) Delivery by the Defendant to the Plaintiff of vacant possession of the property comprised in a Deed of Mortgage dated the 29th day of July, A.D. 2002 and made between the Defendant and the Plaintiff of all that   piece parcel or lot of land being Lot No. 380 of Section 1 in a Subdivision called and known as "Golden Gate Estates" in the Western District of the Island of New Providence on of the Islands of the Commonwealth of The Bahamas the particulars of which are set out in the Schedule hereto:

            b) Judgment in the amount of $88,507.49 with interest payable thereon at the rate of 10% per annum to the date of judgment and thereafter at the rate payable pursuant to the Civil Procedure (Award of Interest) Act;

            c) Such further and other relief as the Court may deem just;

            d) Costs.

2. Publication of this Notice hereby constitutes service of the said Originating Summons upon you.

 The Defendant may obtain the said Originating Summons and supporting documents from the Chambers of Seymour & Co., during normal office hours. And Further Take Notice that unless you the Defendants enter an appearance by filing the same in the Registry of the Supreme Court within fourteen (14) days of the date hereof the Court may proceed in this action in your absence and make such Order as it deems just.
