Man gets five years for shooting man outside apartment

A man was yesterday sentenced to six years for shooting a man outside an apartment.

In October, a jury by a majority verdict of 7-2 found that Kenwood Miller was responsible for the January 23, 2010 shooting of Dereck Walters outside an apartment on Shrimp Road.

According to Walters, he went to an apartment that Miller's girlfriend shared with his close friend Eutrice Carey.

Walters said he contacted her via cell phone after learning she was not there. Walters said he decided to wait on a wall because Carey said she was headed home.

Walters said that Miller, whom he did not know well, confronted him and asked why he was there. According to Walters, Miller attacked him and he fell off the wall.

He claimed that Miller then pulled a handgun and shot him in the stomach and leg.

In an unsworn statement, Miller acknowledged that a scuffle occurred after he asked Walters why he was outside the apartment.

However, Miller said he ran away after he heard gunshots because he assumed he was being fired upon.

Justice Vera Watkins imposed the six-year sentence after considering the 11 months Miller spent on remand and the aggravating and mitigating factors of the offense.

The sentence takes effect from October 12, 2011.

Murrio Ducille appeared for Miller and Linda Evans prosecuted.
