Murder charge reinstated

Prosecutors yesterday reinstated a murder charge against four men, a day after a magistrate discharged the case because of the repeated failure of witnesses to appear.
Seriozha McKenzie, 32, of London Avenue, Miller's Heights; Merritt Forbes, 27, of Chesnut Street, Pinewood Gardens; Kooban Barr, 27, of Lynden Pindling Estates; and Teddy Butler, 25, were arraigned before acting Magistrate Jeanine Weech-Gomez for the May 7, 2010 shooting death of 17-year-old Berkley Miller.
Magistrate Derence Rolle-Davis on Monday dismissed the case, which had been before his court for 15 months when civilian witnesses did not show up for the preliminary inquiry.
Prosecutors now plan to bypass the hearing in the magistrate's Court and send the case to the Supreme Court by a voluntary bill of indictment.
All of the defendants were remanded to prison. However, Senior Justice Jon Isaacs approved $20,000 bail for McKenzie who was free during the hearing before the                magistrate.
