Man pleads guilty to murder a second time

For the second time, Sherman Sherlin Rhodriquez has pleaded guilty to murdering his neighbor almost 11 years ago.

Rhodriquez first pleaded guilty to the 2004 murder of Dale Hepburn in June 2010 on the understanding that the Crown would recommend a sentence of not more than 20 years. However, the Crown reneged on the agreement by failing to recommend a sentence and Rhodriquez was sentenced to 60 years' imprisonment.

In 2012, the Court of Appeal overturned the conviction and ordered a retrial. That second trial was scheduled to take place before Justice Roy Jones on Tuesday and Rhodriquez pleaded guilty again before any evidence was taken.

Hepburn had once tutored Rhodriquez in Spanish. Rhodriquez told police he had used cocaine and alcohol when he went to the victim's home on November 1, 2004. Rhodriquez intended to rob her because he needed money to buy more cocaine. Hepburn let him in the house after he told her he needed to use the phone, as his mother was ill.

Rhodriquez, who was on bail, has been remanded into custody until his sentencing on July 13.

Kevin Farrington appeared for the Crown. Hepburn was represented by court-appointed lawyer Christina Galanos.
