Judge to decide on bail for attempted murder charge

A man awaiting trial on two counts of attempted murder will learn whether he will be released ahead of his trial on Thursday.
Omar Chisholm, 36, of Yamacraw Beach Estates, is scheduled to be tried for the attempted murders of Kevin Johnson and Franky Pierre on September 14, 2015.
The complainants reportedly identified Chisholm as the gunman who shot them near the Esso Service Station on East Bay Street in October 2011.
Chisholm's lawyer Krysta Mason-Smith has argued that Chisholm has not been tried within three years - the period codified by statute as a reasonable time.
On the other hand, prosecutor Ambrose Armbrister argued that Chisholm was not only in prison awaiting trial but he was serving a four-year sentence for having seven pounds of marijuana with intent to supply since 2013.
Armbrister noted that the offense does not qualify for remission - a one-third reduction of sentence to encourage good behavior.
He said that the Court of Appeal affirmed Chisholm's four-year sentence in September 2013 and Chief Magistrate Joyann Ferguson-Pratt was acting outside of her powers when she reduced the sentence to 19 months after the mandatory minimum sentencing regime for drug offenses was struck down as unconstitutional. Chisholm has previous convictions for drugs in Florida and The Bahamas.
Chisholm appeared before Justice Bernard Turner yesterday for the continuation of his bail hearing. Turner deferred his decision to Thursday morning.
